California real estate practitioners should understand that their real estate license actually allows them to operate under an exception to the general rule that people are not allowed to practice law without being an active member of the State Bar of California. In other words California real estate licensees are in effect permitted to "practice law" within a narrow defined field covered by the California real estate licensing laws. This manual will address the scope of permitted activities and how not to cross over the line into areas where an attorney should be involved.

ABOUT THE AUTHOR

Peter Lewi is a graduate of Occidental College and the University of Southern California School of Law. Early in his legal career, Mr. Lewi collected a substantial sum of money from the United States Air Force representing a client that encountered subsurface rock in the course of constructing military housing. He also tried what was at the time the biggest earth moving case in the history of Los Angeles County involving the excavation of hundreds of thousand of cubic yards of earth in connection with the construction of high end housing in Bel Air. Thus to say that Mr. Lewi learned the real estate business from the ground up is an understatement. He started beneath the surface.

Mr. Lewi has been a real estate developer and his projects have included condominiums and office buildings in Santa Monica. Mr. Lewi is also a California real estate broker and has personally listed and sold property. In recent years he has been highly specialized in residential real estate law serving for four years as General Counsel for Dyson & Dyson Real Estate Associates, a high-end brokerage firm in San Diego County and currently as San Diego Counsel for Coldwell Banker Residential Brokerage. Having worked for the last five years on hundreds of transactions, Mr. Lewi combines a thorough knowledge of all aspects of residential real estate law with hands on experience in the day-to-day conduct of the real estate brokerage business.
